TERMS & CONDITIONS

Welcome to FasterNote! These Terms and Conditions (“Terms”) govern your access to and use of our website, www.fasternote.com (“Website”), and our Software-as-a-Service (SaaS) product, FasterNote, owned and operated by GoldSlateNote, Inc. DBA FasterNote (“Company,” “we,” “our,” or “us”).

By accessing or using our Website and Services, you agree to be legally bound by these Terms. If you do not agree, you must not use our Website or Services.

1. Definitions

  • “FasterNote” refers to our SaaS platform that allows therapists to generate automated progress notes based on predefined selections.
  • “User” or “You” refers to any person who accesses or uses our Website or Services.
  • “Subscription” refers to the monthly or annual payment plans users subscribe to for accessing FasterNote.
  • “Content” includes all text, graphics, logos, trademarks, and intellectual property owned by us.

2. End User License Agreement (EULA)

By using FasterNote, you are granted a non-exclusive, non-transferable, limited license to use the platform for personal and professional purposes, subject to the following conditions:

2.1 License & Usage

  • The license is granted for individual use only; it may not be shared, transferred, or resold.
  • FasterNote may not be reverse-engineered, decompiled, or modified in any way.
  • Users are responsible for ensuring that their use of the platform complies with any applicable laws and professional regulations.

2.2 Ownership & Intellectual Property

  • All FasterNote content, design, logos, and trademarks are our exclusive property and may not be copied, distributed, or modified without permission.
  • Users may provide feedback & suggestions, but we retain the right to use them without compensation.

2.3 Termination of License

FasterNote reserves the right to terminate access without notice if a user:

  • Violates any terms in this agreement.
  • Engages in unauthorized use, sharing, or resale of the software.

3. AI Functionality Terms

3.1 Terms of Use for AI Features (General)

FasterNote incorporates AI-powered features for refining and generating psychotherapy notes. Users must follow strict data privacy guidelines, including HIPAA compliance:

  • No PHI Entries: Users must not enter Protected Health Information (PHI), such as client names, dates of birth, or any identifying details.
  • AI Isn’t Perfect: AI-generated content should be reviewed and edited before use to ensure accuracy.
  • Potential Security Risks: While FasterNote encrypts data, no digital platform is 100% secure. Users assume responsibility for any data they input.

3.2 Terms of Use for AI Note Feature (Specific to AI Note)

  • The AI Note feature uses third-party AI services (such as OpenAI) for processing text.
  • No client-identifiable data should be input into AI processing fields.
  • Users must review AI-generated text to ensure compliance with ethical and professional standards.

Users accept all risks associated with AI note processing and acknowledge that FasterNote is not liable for any misinterpretations or inaccuracies in AI-generated content.

4. Eligibility

To use FasterNote, you must:

  1. Be at least 18 years old or the legal age of majority in your jurisdiction.
  2. Agree to provide accurate, complete, and up-to-date information when creating an account.

    Not use the service for any illegal or unauthorized purposes.

5. Account Creation & Free Trial

  • Users must create an account to access FasterNote.
  • Every new user is eligible for a one-time 24-hour free trial. After the trial, a subscription plan is required to continue using the service.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

6. Subscription Plans & Pricing

FasterNote offers single-user and multi-user subscription plans, billed either monthly or annually:

6.1 Single User Plans

  • Basic Monthly Plan:
    • Price: $9/month
    • Features: Access to core note-taking features, customizable options, and export functionality.
  • Annual Plan:
    • Price: $90/year ($7.50/month) – 16% discount (Save two months by paying annually!).

6.2 Additional/Multiple Users Add-On

  • Monthly Add-On (for additional users):
    • Price: $5 per user per month.
  • Annual Add-On (for additional users):
    • Price: $50 per user per year (~$4.17/month, 16% discount).

6.3 Free Trial Policy

  • Every new user is eligible for a one-time 24-hour free trial.
  • After the trial, a subscription is required to continue using the service.

7. Payment, Cancellation & Refund Policy

7.1 Payment Terms

  • Payments are automatically billed at the start of each billing cycle (monthly or annually).
  • Users must provide valid payment details for uninterrupted service.
  • If payment is declined or fails, access to the service may be restricted until payment is resolved.

7.2 Cancellation Policy

  • Users may cancel their subscription at any time through the account settings on our website.
  • Monthly subscriptions remain active until the end of the billing cycle, and no further charges will be made.
  • Annual subscriptions are non-refundable—once payment is made, there are no refunds for early cancellation.

7.3 Refund Policy

  • No refunds will be issued for any subscriptions, including monthly and annual plans.
  • The 24-hour free trial allows users to evaluate the service before committing to a paid plan.
  • Refunds are only provided where required by law.

8. License & Restrictions

FasterNote grants you a limited, non-exclusive, non-transferable license to use the SaaS platform under the following conditions:

You May Not:

  • Copy, modify, distribute, sell, or lease any part of our Service.
  • Reverse engineer or attempt to extract the source code.
  • Use the Service for commercial resale or redistribution.
  • Upload, share, or distribute illegal, harmful, or inappropriate content.
  • We reserve the right to terminate your license if you violate these terms.

9. Intellectual Property

  • All trademarks, logos, designs, and FasterNote content are our exclusive property.
  • Users may not use our branding, logo, or copyrighted materials without written permission.
  • Any feedback or suggestions submitted to us can be used freely without compensation or credit.

10. Promotions, Contests & Sweepstakes

  • FasterNote may offer promotions, contests, or sweepstakes from time to time.
  • Participation in any such offers is voluntary and subject to additional rules.
  • We reserve the right to modify or cancel promotions without notice.

11. Data Protection & GDPR Compliance (For EU Users)

FasterNote complies with the General Data Protection Regulation (GDPR) and protects the personal data of EU users.

11.1 Your Rights Under GDPR

  • Right to Access: Request a copy of your stored personal data.
  • Right to Rectification: Update or correct your personal information.
  • Right to Deletion: Request the removal of your data unless legally required to retain it.
  • Right to Restriction: Restrict processing of your personal data.
  • Right to Data Portability: Transfer your data to another provider.
  • Right to Object: Object to processing for direct marketing purposes.

How We Use Your Data

  • We only collect data necessary for account management and service delivery.
  • We do not sell, rent, or share your data with third parties except as required by law.

14. Disclaimers & Limitation of Liability

  • FasterNote is provided “AS IS” without warranties of any kind.
  • We do not guarantee that our platform will be error-free or uninterrupted.
  • We are not responsible for any loss of data, business interruption, or damages resulting from using FasterNote.
  • In jurisdictions where liability limitations are not allowed, our liability will be limited to the maximum extent permitted by law.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of Nevada, United States. Any disputes must be resolved through binding arbitration in Nevada, except where prohibited by law.
